FWO - Court orders Ararat man to back-pay two Stawell security guards 27.11.09

Basically Parmenter agreed to a weekly payment plan in return for the FWO not seeking a penalty against him...

The federal workplace watchdog is prosecuting an Ararat man whose former security business allegedly underpaid two employees almost $18,000.

Documents lodged in the Magistrates Court of Victoria allege that Raymond Timothy Parmenter underpaid two full-time security guards who worked for him between 2006 and 2008.

It is claimed the men are owed $16,770 and $1040 respectively. Their duties included working as static security guards at the gatehouse of the Stawell Gold Mine.

Parmenter was sole trader of the RHTC security business.

Fair Work Ombudsman Victorian Director Rhonda Murray says it will be alleged in Court that Parmenter underpaid the men’s shift penalties, overtime rates, weekend and public holiday penalty rates.

Ms Murray says the decision to initiate legal proceedings was made after Parmenter failed to rectify the alleged underpayments.

The Fair Work Ombudsman is seeking a Court Order for Parmenter to repay the money, as well as a penalty.

He faces a maximum penalty of $6600 per breach of the Workplace Relations Act.
