I have just discovered that SPL Security Group have an Enterprise Agreement that is supposedly been negotiated legally and is in front of the Fair Work Commission for approval.

This agreement falls short of what you would receive under the Security Services Industry Award 2010 See: https://www.fwc.gov.au/documents/documents/modern_awards/award/MA000016/default....

It contains flat pay rates for different periods of working which when compared to the Security Services Industry Award 2010 fall short.

The current Level 1 pay scale per hour in the Security Services Industry Award 2010 is:

Night              Day            Sat              Sun              Pub Hol
$23.06         $18.95          $28.43           $37.90    $47.38

Casual Rate:

Night             Day            Sat              Sun              Pub Hol
$30.53        $26.01         $36.42         $46.82          $57.23

Go to the end of the agreement. It has not been signed. I wonder if the employees know who was their employee representative?

This agreement is a duplication of other enterprise agreements from other security firms that have been approved by a incompetent Fair Work Commissioner. It does not pass the 'Better Off Overall Test' that is to say that workers are better off under this agreement.

The Fair Work Commission may approve this agreement with undertakings. That is it is left to SPL Security Group to audit wages that are paid under this agreement and recompense workers for any shortfall and pigs will fly! Shocked

This agreement was made in the Workchoices era where the pay scale in the agreement was well below the award rate at the time. They continue to pay below the award rate. Be aware of sham contracts and cash-in-the-hand  which are all illegal ways of being paid.

If you are working or have worked for SPL Security Group then check what you have been paid with what you should have been paid under the Security Services Award 2010.

Under this agreement you will be required to pay  a deposit $50. This clause goes against the condition of Security Service Industry Award Clause 15.11:
‘Other matters (b)
Uniform
Where an employee is required to wear a uniform the employer must provide the employee with the uniform or reimburse the employee for the cost of the uniform.

This agreement has a voluntary overtime clause. You will be pressured to sign an agreement on being employed where you state that you voluntarily work overtime for normal rates therefore not be paid overtime rates.

You will not be paid for meal breaks if you are required to stay at your post. This clause does not define unpaid meal break sufficiently in regard to the Security Services Industry Award 2010
