Admin, the victim was a union delegate and the aggressor has been moved off site. All OK, well now there appears to be a campaign by a few of the aggressor's mates to have a go at the victim. I can't say much because some of the people I work with read this site.

It is also a workplace health and safety issue: http://www.safework.nsw.gov.au/

It is best the victim knows his rights before confronting management. You probably find what occurred is termed assault in criminal law. The victim can take his case to the police.

OK this is in NSW, and the victim does not want the aggressor sacked by the manager just moved off site. It is unfortunate that the aggressor is known to have a temper. And there were two managers present and two other people so it can't be ignored.
Management are investigating but have not yet ask the victim what they want done.
By the way I am not involved I know the victim.

You need to be more specific.

First of all the Queensland Criminal Code 1899 Section 245 Definition of assault

(1) A person who strikes, touches, or moves, or otherwise applies force of any kind to, the person of another, either directly or indirectly, without the other person's consent, or with the other person's consent if the consent is obtained by fraud, or who by any bodily act or gesture attempts or threatens to apply force of any kind to the person of another without the other person's consent, under such circumstances that the person making the attempt or threat has actually or apparently a present ability to effect the person's purpose, is said to assault that other person, and the act is called an assault.

(2) In this section

applies force includes the case of applying heat, light, electrical force, gas, odour, or any other substance or thing whatever if applied in such a degree as to cause injury or personal discomfort.


I would say other states definition of assault is the same. So did a criminal act happen?

Please use the words 'aggressor' , 'victim', 'Manager' in the second part of your sentence to describe people' but the person doesn't want the other bloke sacked, just moved.' to get a better understanding of what the situation is.

Was there provocation by the victim to cause the aggressor to react? What was the Manager's response? What do you think should have happened to solve this situation.

What do you do when a worker threatens another worker in front of senior management but the person doesn't want the other bloke sacked, just moved.
